1. Account Terms

  3. Only one free account per person or legal entity is permitted.
  4. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  5. Sharing your login credentials is strictly prohibited.
  6. You are responsible for complying with all applicable local, state, national, and international laws.
  7. Use of automated tools (such as bots or spiders) to access, monitor, or copy any part of the Services is prohibited.
  8. You may not resell, duplicate, reproduce, or exploit any part of the Services without our written permission.
  9. We may modify, suspend, or discontinue the Services at any time without liability.
  10. Upon account termination, all your data will be permanently deleted.

2. Use of Services

  1. You agree to use our Services only for lawful purposes and in compliance with all applicable laws and these Terms.
  2. We use major telecom and mobile operators to transmit messages and calls. Delivery times are not guaranteed, and undelivered messages may be discarded without notice.
  3. Free Call Center is not liable for any losses due to non-delivery or delays.
  4. All messages and broadcasts are deemed to have zero monetary value.

3. Usage Policy

  1. You must have consent from all recipients before sending messages or calls using our Services.
  2. You agree to comply with all relevant laws, including but not limited to the TCPA, FTC, FCC, and state regulations.
  3. You must immediately honor “Do Not Call” (DNC) and opt-out requests.
  4. Prohibited practices include:
    • Sending unsolicited marketing messages (spam)
    • Contacting emergency or utility services
    • Using random number generators
    • Collecting personal information without consent
    • Misleading recipients about your identity
    • Transmitting viruses or harmful software
    • Any illegal, abusive, or harmful conduct
  5. Prohibited content includes:
    • Pornography
    • Harassment
    • Firearms, alcohol, tobacco, illegal drugs
    • Gambling, investment solicitations
    • Multi-level marketing
  6. All outbound campaigns must include valid legal contact information in the initial greeting.
  7. You are solely responsible for your content and campaign compliance.

4. Payment Terms

  1. A valid credit card is required for paid accounts; free accounts do not require payment information.
  2. Free accounts may have feature restrictions and may be changed or discontinued at any time.
  3. Paid Services are billed in advance and are non-refundable.
  4. Non-payment may result in account suspension or termination.
  5. All fees are exclusive of taxes, which you are responsible for.
  6. We reserve the right to modify service fees with 30 days’ notice.
  7. Unused credits expire as specified in your plan and are non-refundable.

5. Cancellation and Termination

  1. You are responsible for properly canceling your account.
  2. All content is deleted immediately upon cancellation and cannot be recovered.
  3. No refunds are issued for canceled services.
  4. We reserve the right to terminate or suspend any account at any time for any reason.
  5. Inactive accounts (no login activity for 90+ days) will be permanently deleted.

6. Intellectual Property

  1. Gventure Communication owns all rights to the code, design, and layout of the Services.
  2. You retain ownership of your uploaded content but grant us a license to use it for operating and promoting the Services.
  3. You may not copy, reproduce, or exploit any part of the Services without written permission.

7. Warranties and Limitations of Liability

  1. The Services are provided “as is” and “as available.” We do not guarantee that the Services will meet your requirements, be error-free, or always be available.
  2. Free Call Center is not liable for direct, indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
  3. Our total liability will not exceed the fees paid by you in the month preceding any claim.
  4. Some jurisdictions do not allow such exclusions or limitations, so they may not apply to you.

8. User Responsibilities and Indemnification

  1. You are fully liable for all communications sent from your account.
  2. You agree to indemnify and hold harmless Free Call Center and its affiliates from any third-party claims, including but not limited to breaches of these Terms, law violations, or disputes with your customers.
  3. You must use the Services responsibly and at your own risk.

9. Responsible Use

  1. You agree to comply with all applicable laws and regulations regarding dialing, messaging, and faxing.
  2. You must honor all DNC and opt-out requests and include valid contact information in outbound campaigns.
  3. You are responsible for providing all content, data, and scheduling of your campaigns.
  4. Do not contact emergency or life-line services.
  5. Only send outbound sales broadcasts to recipients who have given prior consent.

10. Legal and Dispute Resolution

  1. These Terms are governed by the laws of the Hong Kong Special Administrative Region.
  2. Any disputes will be resolved by binding arbitration in Hong Kong under the rules of the Hong Kong International Arbitration Centre, on an individual basis.
  3. Either party may seek equitable or injunctive relief in court for breaches causing irreparable harm.

11. Confidentiality

  1. Both parties agree to protect each other’s confidential information and only use it as necessary to fulfill obligations under these Terms.
  2. Confidentiality obligations do not apply to publicly known, independently developed, or lawfully obtained information.

12. General Conditions

  1. These Terms constitute the entire agreement between you and Free Call Center (Gventure Communication).
  2. Failure to enforce any provision is not a waiver of rights.
  3. If any provision is found unenforceable, it will be modified to best achieve its intent, and remaining provisions remain in effect.
  4. Gventure Communication may assign its rights without your consent; you may not assign your rights without our written consent.

13. Ecommerce & Payment Terms (If Applicable)

  1. By using our e-commerce features, you agree to additional terms regarding account activation, payment gateways, fee structure, intellectual property, and your responsibilities for customer service and compliance.
  2. No refunds are provided under any circumstances.

14. Law Enforcement and Compliance

  1. We may disclose information to law enforcement as required by law.
  2. You are responsible for compliance with all applicable DNC regulations.
